Can I Afford A Personal Injury Claim?

If you have been harmed because of another person’s negligence, you will be legally entitled to pursue a personal injury claim. This will enable you to obtain compensation for the pain, suffering and financial losses you have incurred as a result.

However, you might be worried about the cost of a personal injury claim. Indeed, legal action is often thought of as being expensive and this worry might discourage you from taking the matter any further. But it should not be a cause for concern, as there are various ways to cover your costs ensuring you are able to claim the compensation you rightfully deserve.

There are a number of different ways to cover the cost of your personal injury claim, including the following:-

  • No win no fee – many firms still offer to pursue a claim under a No Win, No Fee Agreement. If you lose your claim you pay nothing for your legal fees, although due to recent changes in the law you may have to make a contribution to your legal costs if your claim is successful. We can advise you of the full details on a free, initial enquiry.
  • Insurance – some insurance policies have legal expenses cover attached which will cover the cost of a personal injury claim. Many will not even be aware that they have legal expenses insurance, so it is worth checking your insurance policies (such as your motor and household contents insurance) if you do wish to make a claim.
  • Trade union – some trade unions will provide free legal representation for their members. If you are a member of a trade union and you would like to make a personal injury claim, you need to check whether you are entitled to free union representation.
  • Pro bono – pro bono is when a professional offers their services for free or for a reduced fee. Not all law firms are able to offer pro bono personal injury claims, but those who do will provide free legal assistance to those who cannot pay and have no other form of funding.
  • Legal aid – as of 1 April 2013 changes to the law mean that legal aid is no longer available to people making a personal injury claim.

A solicitor who specialises in personal injury claims will be able to advise you upon the various funding options available, suggesting what method would best suit your situation.
