A Lasting Power of Attorney is a legal document which ensures your affairs are dealt with by the person you trust (or persons) in the event that you no longer have the mental capacity to do so. This can guarantee you the peace of mind knowing that should this happen, your choices and decisions will be made just as you would want them to be.
This is where a Lasting Power of Attorney (LPA) can help. In the future there may come a time when you become unable to deal with your own affairs due to poor health or age. It is important that should this happen, you have appointed someone you can trust (your Attorney), who will have the legal ability to act on your behalf.
Lasting Power of Attorney can be divided into two groups, one that relates to your finances and one which refers to your health care and general welfare.
- Financial: allows the person nominated (Attorney) to make decisions relating to bank accounts, payment of bills, selling or buying property etc.
- Health care: allows the person nominated (Attorney) to make decisions relating to the use or refusal of treatment, along with your general health and welfare.
This could be to do with where you would live, day to day care, and could also go as far as giving/refusing consent to life-sustaining treatment.
When someone becomes incapable of managing their affairs, their family and friends can have a very difficult time organising or managing their affairs. They may have to apply to the Court of Protection for a court order to enable someone to be able to act for you. As you can imagine this can be costly, stressful and time consuming for both you and your family.
